1. Introduction

Welcome to eServices Kenya ("we," "our," "us"). By accessing or using our website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

eServices Kenya is a virtual cyber services platform that connects customers with digital service providers for government, business, education, and design services.

2. Definitions

  • "Customer" or "You" refers to the person using our services.
  • "Service Provider" refers to eServices Kenya and its agents.
  • "Services" refers to all digital assistance, document processing, application filing, and design services offered.
  • "Membership Card" refers to the premium membership that entitles customers to one free service per day.
  • "Order" refers to a service request placed by a customer.

3. Service Description

eServices Kenya offers a wide range of digital services including but not limited to:

  • Immigration and passport services
  • Civil registration (birth, death, marriage certificates)
  • Business registration and company services
  • KRA tax filing and PIN registration
  • NTSA driving license and vehicle services
  • Land and property services
  • Police clearance certificates (Good Conduct)
  • Education services (KUCCPS, HELB, TVET applications)
  • Logo design, branding, and graphic design services
  • CV writing and career services

All services are provided as assistance only. eServices Kenya acts as an intermediary to help customers navigate digital platforms and does not guarantee specific outcomes from government agencies or third parties.

Important Note: eServices Kenya is an independent service provider and is not affiliated with any government agency. We provide assistance and guidance to help you complete your applications. All government fees are paid directly by the customer.

4. Membership Card Terms

4.1 Membership Benefits

The eServices Kenya Membership Card costs KES 250 and is valid for 365 days from the date of purchase. Membership benefits include:

  • One (1) FREE service request per 24-hour period
  • Priority support and faster response times
  • Access to member-only promotions

4.2 Free Service Limitations

  • Only one free service can be requested per calendar day
  • The free service resets every 24 hours
  • Additional services requested on the same day will be charged at regular prices
  • Free services apply to standard processing only (express fees may apply separately)

4.3 Membership Validity

  • Membership cards are non-transferable
  • No refunds will be issued for unused membership periods
  • Membership can be renewed before expiration for continued benefits

5. Payment Terms

  • All service fees are quoted in Kenyan Shillings (KES).
  • Payment must be made before service delivery unless otherwise agreed.
  • We accept payments via Paystack (Card, M-Pesa, and bank transfers).
  • Membership fees are non-refundable after the card has been issued.
  • Government fees are paid directly by the customer or collected on their behalf.
  • Additional fees for express services (24-hour or same-day processing) will be quoted separately.

6. User Responsibilities

As a customer of eServices Kenya, you agree to:

  • Provide accurate and truthful information in all service requests.
  • Upload valid and clear copies of required documents.
  • Respond promptly to our team's inquiries via WhatsApp.
  • Pay all applicable fees before service delivery.
  • Use the membership card benefits in accordance with the terms.
  • Not misuse, share, or transfer your membership account to others.

7. Privacy and Data Protection

We take your privacy seriously. By using our services, you agree to our Privacy Policy. We collect and process personal information including:

  • Full name, phone number, email address, and ID/passport number
  • Uploaded documents (IDs, photos, certificates)
  • Service request history and preferences

We use this information solely to provide the requested services and will not share your data with third parties except as necessary to complete your requests (e.g., submitting to government portals).

8. Refund and Cancellation Policy

  • No refunds will be issued for services that have already been processed or submitted to government agencies.
  • If a service cannot be completed due to our error, we will either reprocess it free of charge or issue a full refund.
  • Membership card fees are non-refundable after purchase.
  • Cancellation requests must be made within 1 hour of placing an order for a full refund.
  • Refunds are processed within 7-14 business days.

9. Limitation of Liability

To the maximum extent permitted by law, eServices Kenya shall not be liable for:

  • Delays caused by government systems, network issues, or third-party platforms.
  • Rejection of applications by government agencies due to incorrect information provided by the customer.
  • Any indirect, incidental, or consequential damages arising from the use of our services.
  • Loss of data or documents uploaded by the customer.

Our total liability for any claim arising from our services shall not exceed the total fees paid by the customer for that specific service.

10. Document Handling and Storage

  • Documents uploaded by customers are stored securely and used only for the requested service.
  • Documents are automatically deleted after 30 days from the completion of the service.
  • Customers are advised to keep copies of all documents for their records.
  • We use temporary file storage services (File.io) for document transfer, which expire after first download or 14 days.

11. Prohibited Activities

You agree not to use our services for:

  • Any illegal purpose or in violation of Kenyan laws.
  • Fraudulent applications or providing false information to government agencies.
  • Attempting to circumvent the one-free-service-per-day membership limit.
  • Sharing membership credentials with unauthorized users.
  • Harassing or abusing our support team.

12. Modifications to Terms

eServices Kenya reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on this page. Your continued use of our services after any changes constitutes your acceptance of the new terms. We will notify users of significant changes via WhatsApp or email.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
